Cross Border Attorney Dan Ujczo Quoted in Financial Post Article on NAFTA

Dickinson Wright Attorney Dan Ujczo was recently quoted in “Chapter 19 may be a NAFTA deal breaker for Canada, but can it survive a legal challenge in the U.S.?” published by the Financial Post.
Chapter 19 is a mechanism NAFTA members can use to review the fairness of anti-dumping and countervailing duties. A Chapter 19 panel decides each case according to the domestic laws of the country that imposed the duties.
Mr. Ujczo said negotiators will likely connect the fate of Chapter 19 with ongoing disputes, such as softwood. In a note on the negotiations, Mr. Ujczo writes: “The way in which the negotiation teams will address Chapter 19 and dispute resolution will be to leverage their positions by tying in other unresolved trade areas such as softwood lumber and the unfair anti-dumping duties on U.S. gypsum board into Western Canada.”
