Brooks T. Westergard is  a Member in Dickinson Wright’s Reno office. Mr. Westergard’s practice is focused on commercial litigation.

Mr. Westergard is a graduate of the University of Nevada, Reno and earned his juris doctorate from Willamette University College of Law where he graduated cum laude. Following graduation, Mr. Westergard served as a judicial law clerk to the Honorable Justice James W. Hardesty of the Supreme Court of Nevada. After completing his clerkship with Justice Hardesty, Mr. Westergard served as a judicial law clerk to the Honorable Judge Howard D. McKibben of the United States District Court, District of Nevada. As a native Nevadan, Mr. Westergard takes pride in serving the members of his community.

  • Successfully defended a relief defendant in a disgorgement action brought by the United States Securities and Exchange Commission, resulting in a published Opinion from the First Circuit Court of Appeals, SEC v. Sanchez-Diaz, 88 F.4th 81 (1st Cir. 2023).
  • Successfully demonstrated premature failure of an underground storage tank on behalf of the client, recovering full damages after a jury trial.
  • Represented a swimming pool design and construction company in a construction defect action regarding a pool constructed at the plaintiffs’ residence.
  • National counsel for a leading insurance provider group in COVID-19 business-interruption and civil-authority insurance coverage actions.
  • Continuing defense of a gaming and real estate holding company in a shareholder dispute in state court.
  • Negotiated a favorable settlement for a hotel and casino against a class action suit brought by a former employee.
  • Continuing defense in a family/partnership dispute over $300 million in real property holdings.
  • Represented a city in a municipal dispute over a ground lease involving airport hangars, settling the case on favorable terms.
  • Successfully defended a leading provider of anesthesia revenue cycle management against allegations of substandard billing and collection services, prevailing in full at summary judgment.
