Las Vegas Lawyer Jennifer Ko Craft was quoted in the Forbes article titled “The Morality Clause: How #MeToo Is Changing Hollywood Dealmaking”.
The article discusses how sexual misconduct allegations in the entertainment industry have forced studios, distributors and dealmakers to protect their investments through the use of morality clauses in contracts. But when the clauses include ambiguous and subjective language, there’s cause for concern from talent representatives and attorneys. “It’s become so much more difficult to negotiate those morality provisions,” said Ms. Ko Craft. “It’s become of higher important to brand partners.” Public perception plays a major role. “It’s gotten so broad and vague,” Ms. Ko Craft continued. “Now, if the party is in public disrepute, a crime doesn’t need to have been committed if the public views you in a certain light.”
