Jacob Frenkel (Member and Government Investigations & Securities Enforcement Practice Group Chair, Washington, D.C) recently penned an article titled “Criminal Prosecution Exposure In Boeing Investigation May Come To Light With Expert Report,” for Forbes, including a quote from Brenda Roubidoux Taylor (Of Counsel, Las Vegas). In the article, Jacob discusses a recently released report by the Joint Authorities Technical Review in connection with the Federal Aviation Administration’s certification of the Boeing 737 MAX, and the likelihood of criminal prosecution of the company or its employees.
Brenda told Jacob that the results of this investigation could have long-lasting negative consequences, as “the larger aviation community steadfastly believes that threatening aviation professionals with criminal investigations or prosecutions will undermine long-standing self-reporting initiatives, such as the Aviation Safety Action Program (ASAP), that encourage aviation professionals to report voluntarily safety issues and incidents without fear of discipline.”
