Benton Bodamer (Member, Columbus) was recently quoted in the Construction Dive article, “High stakes: State cannabis laws make contractors’ obligations hazy.”
The article discusses the difficult spot companies in the construction industry are finding themselves in with the contradiction between federal law and state cannabis laws and the lack of ability to test for impairment.
“In Maine, employers were initially not allowed to discriminate against their employees or new hires for off-duty consumption. Employers could generally only take action if they could prove the employee in question consumed marijuana on the job, although, more recent updates have softened and confused that black line,” said Benton.
